12. The enforcement of penalties causes severe hardship for
families.
Court cases
13. Ordinary citizens do not have the time and resources to deal
with cases that drag on and on.
14. Ordinary people are limited in their ability to use the legal
language and concepts required in court.
15. People lack lawyers or advisors who can give them legal
advice and suggestions on how to proceed with their cases.
16. Some legal professionals provide people fighting cases only
half-hearted assistance or do not act in the best interests of
their clients.
Compensation for people found to be innocent
17. Citizens who are jailed after being accused in land cases but
found innocent of the charges do not receive compensation
for their time in jail.
Based on the research it is recommended that citizens facing
hardship due to eviction because of land rights cases filed against
them receive proper treatment. They should be entitled to a place
to stay and earn their livelihood so that they can look after their
family and not become a burden on society. To ensure a basic level
of justice, which would allow them to contest a case fairly, it is rec-
ommended that they also be provided any necessary advice on legal
or other matters related to the case.
