local and appeals courts, and relevant reports by agencies such as
the Department of Special Investigations and independent organizations
such as the National Commission on Human Rights and the Office of
the Ombudsman. Additionally, the project visited the communities
and conducted individual and group interviews with people directly
affected by the problems as well as people involved in some related
capacity. The project then conducted public forums at which it
presented the results of its fact-finding investigations. The forums
brought together judges, prosecutors, police, lawyers and government
officials to analyze the situation and suggest ways of dealing with the
problem of land disputes.
The analysis identified 17 entry points for injustice in land
disputes, falling into 5 main categories:
Information and evidence
1. Private interests can gain access to confidential official in-
formation. They can use knowledge of areas and locales
earmarked for government development plans to get
people with land deeds evicted from their land by dishon-
est, unfair means.
2. Ordinary citizens cannot gain access to information or official
records in order to check the legality of suspected fraudulent
documents contesting their land rights.
